Terms of Service

1. Acceptance of Terms

By downloading, installing, or using FocuTime ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. End User License Agreement (EULA)

PLEASE READ THIS EULA CAREFULLY BEFORE USING FOCUTIME

This End User License Agreement ("EULA") is a binding agreement between you ("User") and the developer of FocuTime ("Developer"), not with Apple Inc. The Developer, not Apple, is solely responsible for FocuTime and its content.

2.1 Scope of License

The Developer grants you a limited, non-exclusive, non-transferable, revocable license to use FocuTime on any Apple-branded device that you own or control, solely for your personal, non-commercial purposes. You may not:

  • Distribute, sublicense, rent, lease, or lend the App to any third party
  • Copy or modify the App or any portion of it
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code
  • Remove any proprietary notices or labels from the App
  • Use the App for any unlawful purpose or in violation of any regulations

2.2 Maintenance and Support

The Developer is solely responsible for providing maintenance and support services for FocuTime. Apple has no obligation whatsoever to provide any maintenance or support with respect to FocuTime. Any support inquiries should be directed to the Developer, not Apple.

2.3 Warranty

The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) paid for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation regarding FocuTime. All other warranty claims are the sole responsibility of the Developer.

2.4 Product Liability

The Developer, not Apple, is responsible for addressing any claims by you or any third party relating to FocuTime or your possession and/or use of FocuTime, including but not limited to: (i) product liability claims; (ii) any claim that FocuTime fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

2.5 Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

2.6 Third-Party Beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this EULA, and that upon your acceptance of the terms of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

3. User Responsibility

YOU ARE SOLELY RESPONSIBLE FOR:

  • Your use of the App and all consequences thereof
  • Any decisions you make based on using the App
  • Managing your own productivity and time
  • Ensuring the App is suitable for your needs before purchase
  • Any apps you choose to block and the consequences of blocking them
  • Your subscription purchases and payment decisions
  • Maintaining access to your Apple ID and iCloud account

4. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Fitness for a particular purpose
  • Merchantability
  • Non-infringement
  • Accuracy or reliability
  • Error-free operation
  • Uninterrupted service
  • Compatibility with your device or iOS version
  • Achievement of any particular productivity results

5. Limitation of Liability

COMPLETE LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • The developer of FocuTime, its affiliates, officers, employees, agents, partners, and licensors SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages whatsoever
  • This includes, without limitation, damages for:
    • Loss of profits, revenue, or business opportunities
    • Loss of data or data corruption
    • Loss of goodwill or reputation
    • Device damage or malfunction
    • Personal injury or emotional distress
    • Any other tangible or intangible losses
  • YOU USE THE APP ENTIRELY AT YOUR OWN RISK
  • The developer accepts NO LIABILITY WHATSOEVER for any loss of productivity, time, data, money, or any other consequences resulting from the use or inability to use the App
  • In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability shall be limited to the maximum extent permitted by law
  • IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM

6. App Blocking & Scheduled Focus

IMPORTANT WARNING ABOUT APP BLOCKING:

  • The app blocking feature uses Apple's Screen Time API and Family Controls framework
  • YOU ARE SOLELY AND ENTIRELY RESPONSIBLE for any apps you choose to block
  • The developer is NOT LIABLE for ANY consequences of blocking apps, including but not limited to:
    • Missing important notifications, calls, or messages
    • Inability to access emergency services or emergency contacts through blocked apps
    • Loss of access to critical work, financial, or personal applications
    • Missing deadlines, appointments, or time-sensitive information
    • Any financial losses due to blocked banking or trading apps
    • Any personal, professional, or medical consequences
    • Any other adverse effects from blocking applications
  • DO NOT block apps that you may need in an emergency
  • YOU ACKNOWLEDGE that blocking certain apps could have serious consequences and you accept full responsibility

6.1 Scheduled Focus (Automated Blocking)

Scheduled Focus allows you to configure recurring automated blocking schedules that activate independently, including when FocuTime is not actively running:

  • YOU ARE SOLELY RESPONSIBLE for configuring, reviewing, and disabling your schedules
  • Schedules may activate automatically at any time based on your configuration — the Developer accepts no liability for automated blocking events
  • You are responsible for ensuring your schedules do not conflict with urgent or emergency app access needs
  • If your subscription lapses, active blocking will be stopped; however, schedule configurations are retained for if you re-subscribe
  • The Developer is NOT RESPONSIBLE for any consequences arising from automated blocking, including but not limited to missed notifications, calls, or time-sensitive information

7. Strict Mode

CRITICAL NOTICE — READ BEFORE ENABLING STRICT MODE

Strict Mode is an optional, voluntary feature that, once enabled for a session or schedule, intentionally prevents early cancellation of the session by design. By enabling Strict Mode, you explicitly acknowledge and agree to the following:

  • YOU VOLUNTARILY CHOOSE to lock your session. This is the intended behavior of the feature.
  • An Emergency Override mechanism is provided within the App for genuine emergency situations. Using it requires answering a security question and waiting for a mandatory cooldown period.
  • The Developer is NOT LIABLE UNDER ANY CIRCUMSTANCES for any consequences arising from a locked Strict Mode session, including but not limited to:
    • Inability to access blocked apps during the session
    • Delays in responding to non-emergency communications
    • Any personal, professional, financial, or medical consequences occurring while a session is locked
    • Consequences of using or not using the Emergency Override
  • DO NOT enable Strict Mode if there is any possibility you may need access to blocked apps for an emergency during the session period.
  • The Emergency Override feature is provided as a convenience and the Developer makes NO WARRANTY that it will be available, functional, or accessible in all circumstances.
  • You are solely responsible for assessing whether Strict Mode is appropriate for your circumstances before enabling it.
  • The Developer reserves the right to modify, change, or remove the Strict Mode feature or the Emergency Override mechanism at any time without notice.

8. No Responsibility for Data Loss

While the App includes iCloud sync functionality, THE DEVELOPER ACCEPTS NO RESPONSIBILITY for:

  • Any data loss, corruption, or synchronization issues
  • iCloud service availability or reliability
  • Conflicts between devices
  • Loss of statistics, settings, or timer state
  • Apple service outages or changes to Apple's APIs

9. Subscriptions and Payments

  • Subscriptions are processed through Apple's App Store
  • YOU ARE SOLELY RESPONSIBLE for your purchase decisions
  • All billing disputes must be handled through Apple
  • The developer is NOT RESPONSIBLE for Apple's billing, refund policies, or payment processing
  • Subscription features may change or be discontinued at any time without notice
  • NO REFUNDS will be provided by the developer - all refund requests must go through Apple
  • You acknowledge that subscription pricing and features are subject to change

10. Notifications

  • The App sends local notifications for timer completion and reminders
  • YOU ARE RESPONSIBLE for managing notification permissions on your device
  • The developer is NOT LIABLE for missed notifications or notification delivery issues

11. Indemnification

You agree to indemnify, defend, and hold harmless the developer and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the App or violation of these Terms.

12. Modifications to Terms

The developer reserves the right to modify these terms at any time without notice. Continued use of the App constitutes acceptance of modified terms. It is your responsibility to review these terms periodically.

13. Termination

The developer reserves the right to terminate or restrict your access to the App at any time, for any reason, without notice or liability.

14. No Warranties on Third-Party Services

The App integrates with Apple services (iCloud, Screen Time, Notifications) and third-party services (Firebase Analytics). THE DEVELOPER MAKES NO WARRANTIES regarding the availability, reliability, or functionality of these services and accepts no liability for their operation or any changes to them.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Governing Law

These terms shall be governed by and construed in accordance with applicable local laws. Any disputes shall be resolved in the appropriate jurisdiction. You waive any objections to jurisdiction or venue in such courts.

Privacy Policy

Our Approach to Privacy

FocuTime is designed with privacy in mind. Your personal data (timer settings, statistics, app blocking preferences) stays on your device or in your personal iCloud account. We do collect anonymous analytics data to help improve the app.

Analytics & Data Collection

WHAT WE COLLECT

We use Firebase Analytics (Google) to collect anonymous usage data to help us understand how the app is used and improve it. This includes:

  • • App opens and session duration
  • • Feature usage (which screens are visited, which features are used)
  • • Timer events (start, pause, complete - NOT your specific timer settings)
  • • Subscription tier (free, student, pro, lifetime)
  • • Device type and iOS version
  • • App version
  • • Crash reports and errors
  • • Country/region (general location, NOT precise location)

WHAT WE DO NOT COLLECT

  • • Your name, email, or any personally identifiable information
  • • Your timer settings or preferences
  • • Which apps you block (this data NEVER leaves your device)
  • • Your statistics or focus time data
  • • Your iCloud data
  • • Your precise location
  • • Your contacts, photos, or any other personal data
  • • Your calendar event details (only the aggregate meeting duration is computed on-device)
  • • Your health or sleep data (only sleep duration is read on-device for the State of Mind widget, if you grant Health access)

Personal Data Storage

YOUR PERSONAL DATA IS STORED LOCALLY ON YOUR DEVICE OR IN YOUR PERSONAL iCloud ACCOUNT

Local Storage

  • Timer settings (work duration, break durations)
  • Statistics (sessions completed, streaks, focus time)
  • App blocking preferences and selections
  • Notification settings
  • All this data is stored locally on your device using Apple's UserDefaults

iCloud Storage (Optional - Pro Feature)

  • If you enable iCloud Sync, your data is synced to YOUR PERSONAL iCloud ACCOUNT
  • This data is stored in YOUR iCloud container, not on our servers
  • WE DO NOT HAVE ACCESS to your iCloud data
  • WE CANNOT SEE what you sync
  • Sync uses Apple's CloudKit framework

Synced data includes:

  • Timer settings
  • Statistics
  • Notification preferences
  • Timer state (for cross-device sync)

What is NOT Synced

App blocking selections are ALWAYS STORED LOCALLY ONLY for privacy. We deliberately keep app blocking data on-device to protect your privacy. This data never leaves your device.

Third-Party Services

The App uses the following third-party services:

1. Firebase Analytics (Google)

For anonymous usage analytics

  • Collects anonymous usage data as described above
  • Data is processed by Google
  • Subject to Google's Privacy Policy
  • You can opt out of analytics by limiting ad tracking in iOS Settings

2. CloudKit (Apple iCloud)

For optional data sync (Pro users only)

3. Screen Time API / Family Controls (Apple)

For app blocking (Student, Pro, and Lifetime subscribers)

  • Managed entirely on-device by Apple
  • App blocking data never leaves your device
  • Subject to Apple's Privacy Policy

4. EventKit (Apple Calendar)

For calendar-based features (calendar access permission required)

  • Used to detect upcoming meetings for automatic focus scheduling
  • Used by the State of Mind widget (Pro) to calculate daily meeting load as part of the cognitive load score
  • Calendar event data is read on-device only and never leaves your device
  • We do not store, transmit, or share any calendar data
  • Subject to Apple's Privacy Policy

5. HealthKit (Apple Health)

For sleep data — optional, used by State of Mind widget (Pro feature)

  • If Health permission is granted, the app reads your sleep duration to factor it into the cognitive load score shown in the State of Mind widget
  • Sleep data is read on-device only and never leaves your device
  • We do not store, transmit, or share any health data
  • You can revoke this permission at any time in iOS Settings → Health → Data Access
  • Subject to Apple's Privacy Policy

6. UserNotifications (Apple)

For local notifications

  • All notifications are generated locally on your device
  • No data is sent to external servers

7. StoreKit (Apple)

For in-app purchases

8. WidgetKit / App Groups (Apple)

For Home Screen and Lock Screen widgets

  • Focus statistics (streak, daily minutes, weekly history) are shared with widgets via an on-device App Group container
  • This data never leaves your device
  • No personal data is transmitted to our servers for widget display

Data Security

  • Personal data remains on your device or in your personal iCloud account
  • We do not operate servers that store your personal data
  • We cannot access, view, or recover your personal data
  • Your data security depends on your device security and iCloud account security
  • Analytics data is anonymized and cannot be traced back to you individually

Data Sharing

  • We do NOT sell your data to anyone
  • We do NOT share your personal data with third parties
  • Anonymous analytics data is processed by Google Firebase
  • We may share aggregated, non-identifying statistics (e.g., "X% of users complete 5+ sessions daily")

Children's Privacy

The App is not intended for children under 13. We do not knowingly collect personal information from children under 13. All personal data storage is local or in the user's personal iCloud account.

Data Deletion

To delete your data:

  1. Local Data: Delete the App from your device
  2. iCloud Data: Use the "Delete iCloud Data" option in Settings → iCloud Sync, then delete the App
  3. Analytics Data: Analytics data is anonymized and automatically deleted by Google after retention periods

We cannot delete your local or iCloud data because we don't have access to it.

Your Rights

Depending on your jurisdiction, you may have rights regarding your data:

  • Personal Data: Your personal data is stored on your device/iCloud - you have full control
  • Analytics Data: This data is anonymous and cannot be attributed to you individually
  • Opt-Out: You can limit analytics collection through iOS Settings → Privacy → Tracking

International Users

Personal data processing happens on your device or in your iCloud account. Analytics data may be processed by Google in various locations globally. By using the App, you consent to this processing.

Changes to Privacy Policy

We may update this privacy policy from time to time. We will notify you of any changes by updating the "Last Updated" date. Continued use of the App constitutes acceptance of the updated policy.
